We align our due diligence processes with the UN Guiding Principles on Business and Human Rights (UNGP) and regard respect for human rights as a basic prerequisite for sustainable business success.<\/p><p>This policy complements and deepens our existing\u00a0<strong>Compliance framework<\/strong>\u00a0and our\u00a0<strong>Declaration on the Prevention of Slavery and Human Exploitation<\/strong>\u00a0(\u201eModern Slavery Statement\u201c).<\/p><ol><li><strong>2) Scope of application &amp; reference to standards<\/strong><\/li><\/ol><p><strong>Scope of application.<\/strong>\u00a0This policy applies Group-wide to all units, brands and employees (including management, management functions, employees, work contracts, temporary employees) as well as to suppliers and other business partners, where applicable.<\/p><p><strong>External frameworks.<\/strong>\u00a0Implementation in line with:<\/p><p>UN Guiding Principles on Business and Human Rights (UNGP),<\/p><p>Universal Declaration of Human Rights (UDHR),<\/p><p>International Covenant on Civil and Political Rights (ICCPR) &amp; on Economic, Social and Cultural Rights (ESCR),<\/p><p>OECD Guidelines for Multinational Enterprises,<\/p><p>relevant EU and national regulations, in particular\u00a0<strong>Supply Chain Due Diligence Act (<\/strong><strong>LkSG<\/strong><strong>)<\/strong>\u00a0in Germany and\u00a0<strong>EU Directive 2019\/1937<\/strong>\u00a0(whistleblower protection).<\/p><ol><li><strong>3)\u00a0<\/strong><strong>Governance<\/strong><strong>\u00a0&amp; Responsibilities<\/strong><\/li><\/ol><p><strong>Top view &amp; sound from above.<\/strong><\/p><p><strong>Supervisory and management bodies<\/strong>\u00a0have overall responsibility for this policy, approve annual plans and reports and monitor progress.<\/p><p>The Management Board provides the financial and human resources.<\/p><p><strong>Roles.<\/strong><\/p><p><strong>Chief Compliance &amp; Human\u00a0<\/strong><strong>Rights<\/strong><strong>\u00a0Officer (CCHRO):<\/strong>\u00a0Responsible for implementation, risk analyses, remedial action, reporting (at least annually).<\/p><p><strong>Human\u00a0<\/strong><strong>Rights<\/strong><strong>, Privacy &amp;\u00a0<\/strong><strong>Ethics<\/strong><strong>\u00a0<\/strong><strong>Committee<\/strong><strong>\u00a0(HRPEC):<\/strong>\u00a0interdisciplinary committee (Compliance, Legal, Purchasing, HR, Data Protection\/IT Security, Product, Operations, Communication). Tasks: Prioritization of risks, approvals for sensitive cases\/deals, escalation to management.<\/p><p><strong>External Advisory Panel for Human Rights &amp; Civil Liberties (Advisory Panel):<\/strong>\u00a0Independent experts provide support with complex considerations and dual-use issues (based on the model of external PCL advisory bodies).<\/p><p><strong>Reporting culture &amp; protection.<\/strong>\u00a0We promote an open speak-up culture without retaliation, with internal and external, including anonymous, reporting channels (see section 10).<\/p><ol><li><strong>4) Due diligence processes (Human\u00a0<\/strong><strong>Rights<\/strong><strong>\u00a0due diligence)<\/strong><\/li><li><strong>4.1 Risk analysis (at least annually \/ on an ad hoc basis).<\/strong><\/li><\/ol><p>Identification, assessment and prioritization of human rights and selected environmental risks in own business activities, products\/services and in the supply chain (severity, probability, potential impact).<\/p><p>Focus on high-risk cases (e.g. protection of vulnerable groups, security &amp; privacy, labor rights, forced and child labor, discrimination, freedom of assembly\/expression, land rights, health rights).<\/p><ol><li><strong>4.2 Prevention &amp; mitigation.<\/strong><\/li><\/ol><p>\u201ePrivacy &amp; human rights by design\u201c in products\/services; technical and organizational protective measures; auditability; Data minimization; human rights design reviews. (Approach based on PCL engineering with systemic accountability).<\/p><p>Supplier and business partner requirements (Code of Conduct, contractual assurances, audit rights, training, corrective measures).<\/p><ol><li><strong>4.3 Evaluation of new\u00a0<\/strong><strong>Use<\/strong><strong>-Cases \/ Deals.<\/strong><\/li><\/ol><p>Pre-contractual risk scans (sector, country, end use, customer type, funding sources, sanctions\/PEP check).<\/p><p>\u201eGo\/No-Go\u201c criteria (see section 6) and documented decision in HRPEC. (Inspiration: proactive client scoping &amp; boundaries \/ \u201ewalk-away\u201c practice).<\/p><ol><li><strong>4.4 Reactive measures.<\/strong><\/li><\/ol><p>Procedure for suspected cases of misuse\/damage: Investigation, temporary restrictions, remedial agreements up to and including\u00a0<strong>Suspension\/termination<\/strong>\u00a0of the relationship.
